Comes now the Plaintiff, Edward Labate, a resident of Limestone County, by and through his attorney, Alfred T. Newell, pursuant to Code of Alabama 6-7-100 Ala. Rules of civil procedure 17c, is suing Ed Trice; asking this honorable court to take jurisdiction.
The defendant, Ed Trice is a resident of Philadelphia, Pennsylvania, and is engaged in the business of Gothic Chess Association, Incorporated, organized and existing under the laws of the State of Pennsylvania, publishing internet information regarding chess games, books and chess tournaments.
On or about, to wit, the 1st day of February, 2008 through the 7th day of May, 2008, Ed Trice published false and libelous and defamatory statements concerning the plaintiff and continues to do so by publishing numerous articles, letters, E-mails, or matter, regarding Edward Labate being the perpetrator behind a marketing scheme for a book entitled “My 61 Memorable Games”.
Said book was supposed to have been written and/or authorized by chess celebrity Bobby Fischer as memoirs of his chess games. The book deal, “My 61 Memorable Games”, has now been established as a hoax and the book’s “marketing campaign”, originally undertaken by Ed Trice on the internet, therefore constitutes fraud. (EXHIBIT A)
Ed Trice’s false, libelous and defamatory statements, letters and E-mails were sent to numerous mutual business associates and professional colleagues in a prestigious field and posted on numerous websites, chat rooms and bulletin boards in the public domain of the internet, copies of which are attached hereto: (EXHIBITS 1A-11C attached as evidence, pursuant to Code of Alabama 6-5-187)
1.“Ed Labate = “Helgi” from “My 61 Memorable Games”, now established as a book publishing hoax; (Exhibit #1A)
2.Accused Edward Labate of selling a fraudulent Bobby Fischer autographed book entitled “My 61 Memorable Games”;(Exhibit #2A)
3.Accused Edward Labate of being the perpetrator of the “My 61 Memorable Games’ hoax to the point of actually printing a very large quantity of said books and shipping them to Europe;(Exhibit #3A)
4.Accused Edward Labate of posting fraudulent correspondence with Ed Trice on Labate’s Website; (Exhibit #4A)
5.Trice stated, “I am in possession of an AOL representative’s letter stating they were spoofed, fabricated entirely by Labate.” ;(Exhibit #5A)
6.Accused Edward Labate of fabricating and ‘doctoring’ correspondence from other contacts; (Exhibit #6A)
7.Accused Edward Labate of fabricating E-mails with Cathy Purdy of Bookmasters, Trice’s contact person with whom he himself inquired about printing the book “My 61 Memorable Games” in the summer of 2007; (Exhibit # 7A)
8.Accused Edward Labate of fabricating Trice’s attempts to procure investors including but not limited to Frank Camaratta, Bruce Towell, and others for Trice’s unauthorized printing of the book, “My 61 Memorable Games”;(EXHIBIT #8A)
9.Trice stated he successfully had the Limestone County Sheriff visit Edward Labate on or about January 17, 2008 at his ‘residence’, wherein Labate had not resided since June of 2007.(EXHIBIT #9A)
10.Trice posted this E-mail on CHESSGAMES.COM:“Labate you’re the liar who fabricated EVERYTHING on that page. And since you don’t know what “per se defamation” is, you’ve been invited to Philadelphia to learn all about it.You claim the sheriff never visited your house, yet why then, did you remove the slander from your eBay auction one day later? I called and spoke with “Pat” (who answers their phone) many times. I called the local police on you because HARASSMENT is the first item that needs filing before civil proceedings commence. And the local police told me it was a Limestone County issue, since the mudhole you live in does not dispatch officers to your location. That’s already on the ledger, first things first.I’ve already have had an arbitration board convene to assess damages at $1,000 per day for each day you have that b.s. on your page. I’ve asked you to remove it, you’ve refused (God knows what you have to gain by it) so now each day from the first day of contact will be money in my pocket. I’ve already negotiated 50 cents on the dollar to a firm that buys civil judgements. Let’s see where you’ll move to next, since you have gone bankrupt in California.” (EXHIBIT #10A, EXHIBIT #10B)
11.Trice accused Labate of having “severe psychological problems”; asks Labate, “Dude, are you on drugs?”; accused Labate of forwarding his confidential E-mails (EXHIBIT #11A; EXHIBIT #11B; #11C)
Said remarks, articles, letters or E-mails were and are currently being published to the general public and still remain posted to this day under the name of Ed Trice, as well as his numerous aliases, including but not limited to, Edward A. Trice, Edward J. Trice, ‘James’, ‘Mark’, ‘Paul Mungo’, ‘Blood of Bulls’, ‘Chess V’, ‘Alan McCormick’, ‘GothicChessInventor’, and ‘AverageWoodpusher’. (EXHIBIT A)
Said remarks, articles, letters or E-mails were also published to numerous websites including but not limited to:chessgames.com, Chess ninja.com, NY Times Daily Blog, ChessVibes.com, uschess.org, rehotpawn.com, polgarchess.com, and GothicChess.com. (EXHIBIT A)
Said remarks were also published to numerous mutual business and professional contacts including but not limited to:Frank Camaratta, House of Staunton; Dan Heisman, Chess Master, Teacher and Chess Columnist; Cathy Purdy, Printer/Bookmasters; Ed Hall, US Chess Executive Director. (EXHIBIT A)
Plaintiff was damaged by said false and defamatory statements as follows:
a.Said statements undermined long established trust between plaintiff and numerous professional colleagues within his field of endeavor (marketing books and games on the internet).
b.Plaintiff suffered public ridicule, extreme embarrassment, stress and emotional distress from having to answer related E-mail queries from colleagues in a prestigious field in which bad publicity and/or even one blemish on his reputation ruins career opportunities, causes lost opportunities to be invited to prestigious matches and tournaments, and damaged his ability to sell his legitimate products on the internet.
c.Plaintiff incurred medical bills due to emotional distress and stress.
d.Plaintiff suffered a loss in sales from professional pursuits during the last year and continues to do so as the libel/slander is on-going.
e.Other damages are costs of taking legal action and attorney fees.
Plaintiff claims punitive damages of the Defendant. Plaintiff avers that on the 5th day of May, 2008, Plaintiff, pursuant to the Code of Alabama, 6-5-184 through 6-5-186, requested that Defendant publish a retraction of said statements and that defendant wrongfully refused to retract same. A copy of this notice is attached herewith. (EXHIBIT B)
When the Defendant published said statements, the Defendant knew it was false, and the Defendant published said statements with reckless and gross disregard as to whether said statements were true or false.
1.Said actions are brought under Code of Alabama 6-5-180 through 6-5-189, namely for libel and slander per se. Plaintiff asks this honorable court to award damages and permanently enjoin defendant from engaging in any such libel or slander ever again.
2.Second cause of action common law fraud, Code of Alabama 6-5-100, wherein same said Ed Trice attempted to sell Edward Labate non-existent books and that is his basis for continually slandering Edward Labate, because he was unsuccessful in his endeavor to defraud Labate, and therefore Plaintiff demands punitive damages.
WHEREFORE, Plaintiff demands judgment against Defendant in the sum of $1.2 million compensatory and actual damages and $20,000,000 in punitive damages, plus costs.

Therefore, we have no choice and are proceeding with a $12 Million Lawsuit against Ed Trice for libel/defamation. The email all of you recieved couple hours ago was the 12th count of libel/defamation we officially have. I have stated numerous times that the date on my Bobby Fischer autographed 'My 60 Memorable Games' was inserted by Betty Roberts, and not Bobby Fischer. Yet, this SCUMBAG TRICE has a 'Gregory' give his 'professional' opinon of Betty Roberts signature from 1975...WELL DONE, ED TRICE!!! I'm quite confident we will problably exceed 30 counts by time this gets to trial.
As anyone who has been involved in a lawsuit know, the first thing each side files are discoveries and requests for depositions. This is where the 'fun' now starts. Everything you say in these are considered 'under oath' and false statement are criminal acts, punishable by fines and jail time. For example Ed Trice claims that I had 'My 61 Memorable Games' printed. Our very first question will be for Ed Trice to provide proof of this statement. Yes, back a while ago (several months now) at the Main Line Chess Club Ed showed me a manuscript which he said someone from Iceland had sent him and asked him to work on. Ed was suspicious of several issues and asked me what I thought, and I also told him it sounded suspicious and I made a suggestion on two on being cautious and how I would proceed if I were him.

Joshka: I promised myself, not to reveal my source that permitted me to post last December about a certain auction going on Ebay . I have kept silent, but in order to help a friend who is being slandered, the right thing to do is to go to bat for him.
Some of the postings Ed Labate received from Ed Trice were very similar to emails I also received from Ed Trice. In fact I recall Mr. Trice talking with me about this project as far back as the summer of 2007. In September of 2007, he wrote to me letting me know he was going back to Iceland for a photo shoot for the book. Ed Trice was the person who asked me to post about the auction in December of 2007 when he got the go ahead from a certain unnamed individual. I wanted to keep this source in confidence as I felt I wanted to help him and Bobby, who he claimed was having money problems...
For Mr. Labate to be trashed by Mr. Trice is very, very wrong. I'm still getting emails from this so called"Canadian" seller, who are they from?...Mr. Trice himself?....the whole auction really has taken a turn in a direction I had no idea was possible. I tried to help a friend back in December, now I'm trying to help another friend against unfair allegations from this same friend.
They say evil prevails, when the good do nothing, well, I hope I'm doing the right thing now at least.

In extensive e-mails the Canadian seller repeatedly promised to send me a copy of "My 61 Memorable Games" but never fulfilled this promise. I think that the book may exist on someone’s computer but it has not yet appeared in print. Obviously a strong player with Fritz did a lot of work updating the manuscript, but Fischer had nothing to do with it.
The seller’s story appears to be a fairy tale. “Helgi” was an invented name who simply doesn‘t exist either. Ed.Note- therefore, the guess in the original article that Helgi may be Helgi Olafsson, a big supporter and friend of Fischer, was obviously false.
During three months of dealing with the Canadian Scammer (which I believe is the accurate term for the Liar who strung me along for three months) “she” came up with excuse after excuse for not sending me a copy of the book. The cryptic message I received from Bobby was also bogus. After contacting several people in Iceland who knew Bobby well, I learned that he didn’t need money from a new edition. Nor did he wish to see an algebraic version. As I stated originally, he didn’t even own the rights to My 60 Memorable Games.
I played along with the Canadian seller in order to gather more information, then encountered one falsehood after another -- too numerous to mention. In order to convince me the book actually exists, the scammer sent page 79 and naively asked who this Weinstein was that Bobby kept attacking (knowing full well that Weinstein was Kasparov before he changed his name). Notice the clever ploy of referring to My Great Predecessors by Kasparov as “Weinstein, Volume IV, page 233” to imitate Bobby’s brand of sarcasm.
If the book does surface one of these days, we can pretty much rest assured that it was NOT written or authorized by Bobby Fischer.

Thank you so much for your confirmation!! As I've stated on numerous occasions, I personally purchased the book from Betty Roberts in the mid-80s, almost 25 years ago. And that was the way I purchased, and that's the way it was to remain. There would have no reason to add or subtract anything to that book.
I noticed you have a copy of My 60 Memorable Games containing the autograph of Bobby Fischer. Although popular for its collection of games, having a signed copy is quite rare.
The autograph appears genuine and is similar to other "Bobby Fischer" autographs that I've observed in the past. As I note in my book, there have been eleven variations of Fischer's signature discovered (page 7) with "Bobby Fischer" being the most popular (page 47) For comparison purposes, please visit the following links:
One thing to note, however, I have yet to see a date combined with Bobby Fischer's autograph. In my opinion, if Bobby were to sign a date with his signature, he would make it quite clear, as in a letter writen to the Icelandic Parliment he writes, "Signed this 19th day of January, 2005 at Ushiru Japan." Attached is that letter for your curiosity.
In conclusion, of the many forgeries seen on eBay, I feel that the "Bobby Fischer" autograph in your copy of My 60 Memorable Games, is authentic. So, is this 1383 rated player a different Edward A Trice? Or was the person who posted the comment on the American Checker Federation forum an impostor? Or, heaven forbid, is Trice bullshitting again?
Trice threatens to sue people whenever things turn against him and if Edward Labate had really made up all those e-mails on his site Trice would have him in court by now and Labate would be looking at a huge payment for slander / libel / defamation of character or whatever. The fact that this hasn't happened speaks volumes.

As you know, my wife and I met with Ed Trice and his team in Reykjavik last year. Prior to that, I was invited to invest in the proposed Gothic match between Fischer and Karpov and did offer some suggestions. My thought was that Fischer would never agree to play Karpov, but he would probably play such a match with Spassky. I still believe that. We also met with Olaffson who was acting as the intermediary for Fischer. That entire project was legitimate. I also created several high-end sets of Gothic Chessmen and s few 8 x 10 square Premium chessboards for the match, which we brought with us to that meeting. This is the only time I met with Ed Trice in person.
I have had some contact with Ed since then, always by phone or email, mostly dealing with his Gothic Chess Computer Program and some plastic pieces of his. We discussed my assuming production and distribution of his plastic Gothic Chess Sets. We Also had some contact regarding the proposed Fischer's 61 Memorable Games, or whatever it is called. Not being in the Book Business, I declined.
Regarding whether I consider him a "Close Acquaintance", you can count my "close acquaintances" on the fingers of one hand - and you will still have several fingers left over. My relationship with Ed has been strictly business and I have never had bad dealings with him. He was always honest with me, as far as I can determine, and we are on good terms.

Did you ever have any contact outside of the Reykjavik trip, and do you consider him a close acquaintance???
There's a lot there, but it's worth wading through as Trice just digs himself into a deeper and deeper hole.
Mr Trice resorted to threatening me with legal action and even that he would "hunt me down"! Eventually I realised that he was actually more than a little insane rather than just a con artist and I backed away slowly. I have e-mails from Susan Polgar, Dan Heisman, Frank Camarrata and a reporter who Trice claimed would back up his figures. Needless to say, none of these people had ever seen a Gothic Chess tournament and their dealings with Trice were not as he portrayed them.

Yes I received it. Since that time I had gone back to Icelandto meet Mr. Fischer. We are trying to work out the details where his name will be on the book as the author, yet I handle all of the transactions with Bookmasters. Mr. Fischer is quite a recluse, and I have earned his trust. I just want to make sure we proceed in such a fashion that he does not back away.
As this is not one's ordinary way of proceeding, I look forward to what you might have to say on this matter.
As you requested, I had contacted various book printing services and outlets that specialize in mass production of Perfect Bound books. I had solicited quotes for your upcoming release of "My 61 Memorable Games" with an intended December 1 release date.
The belief is that the book can sell for more than $19.95 without impacting the demand curve. One suggestion is to sell it for $5 more, at $24.95 each, with an initial press run of 100,000 units. This will be more cost effective, and with a higher list price, I believe your $710,000 mark can be reached much more quickly, and, in fact, I can get you much closer to $900,000 within 30 days of its release.
The cost for 50,000 units is $73,275.00 and for 100,000 it would be $96,400.00. A sellout of:
50,000 would generate $1,247,500 in gross revenues, $1,174,225 after payment for printing, leaving $939,380 after my 20% allocation.
100,000 would generate $2,495,000 in gross revenues, $2,398,600 after printing costs, leaving $1,918,880 after my allocation.
At this point we need to examine the cost of high volume sales, which is typically achieved through distributor and reseller relationships, or, as you suggested, by acquiring BobbyFischer.com from Jason and reselling it through a turnkey fulfillment center being driven from that web site.
Jason currently is asking for $65,000 to turn over the domain to me, which you already instructed me not to pursue. If you are still interested in dealing with Jason, let me know. Maybe he will agree to host the sale of your book for a much better rate than resellers who are used to 50% margins. Perhaps he will accept the first $65,000 in sales in exchange to turn over the domain to me. I will discuss it with him if you would like me to pursue this course.
Most resellers buy in bulk at 50% discounts. We would need to specify minimum purchases for these bulk buyers, and also establish the discount rate for them. Maybe we can offer 30% discounts 500+, 40% discounts on up to 1000, and 50% discounts on over 1000. This is just an idea, again, I will let you tell me what you would like to do.
Also, if you go the route of the higher volume purchase, I would need to take on at least one partner to help out with the capital outlay over the $73,000. This money needs to be paid up front, and with no inbound revenue prior to December, I would be too long with too large of a drought to justify tying up more money.
I have a new metaphor for Bobby Fischer: A time vortex.
Every time he sends an email to me, even if at 4 AM my time since it is morning in
Iceland already, he expects an answer within an hour or two. If he does not, he gets cantankerous beyond description, and the next series of emails is ridiculous.
Furthermore, he expects a 1:1 answer for every email. You can't just read 3 or 4 then reply to all with one email.
That having been said, we did strike an accord.
Everyone who orders 500 or more books will be given a 45% discount, but only one time. That is, your first order only is eligible for the discount. Every other order of 500 or more will be given a 35% discount.

I also have some interesting news. Fischer mentioned, in one of his rants, a veiled threat to write a book called "The Myth of Karpov" where he attacks his games rather than praises them.

This email is only reaching 6 individuals whom I trust explicitly. I have been asked to assure that information about this particular book venture does not "get out".
Everyone is aware of Fischer's problems with the UBS absconding his $3,000,000 by freezing the funds and denying him and his attorney access to it. Fischer had less than $25,000 in the bank in
Iceland as of the end of July. He would be close to exhausting this by December of this year.
Long story short: After resuming discussions with me and swearing me to secrecy, he entertained the option of releasing a new book, My 61 Memorable Games, where he adds a new game to his old book and re-annotates a bulk of his older material. I furnished quotes from several different publishers, obtained one that he liked, and now I will be acting in the capacity of the agent that oversees his bulk order drop shipments.
Fischer is difficult to deal with. I am getting no upfront money for the out of pocket expense for this. And, I have to pray he doesn't cancel this at the last minute and leave me hanging. That having been said, I have been granted the green light to continue. He sent his hand written notes to the publisher, who can't "decipher" them, and these were sent to me last week.
I am now in the process of building the book, with an intended December 1 release date.
Fischer has set the pricing for bulk orders as follows:
First time orders, and first time orders only: 45% for 500 or more books.
Every "reorder" after that, 35% off for 500 or more books.
No other price tiering exists. No other discounts apply for higher volume orders.
Fischer wants me to place an initial order for 100,000 books, but I will only place one for 50,000 unless there is a compelling reason to do otherwise. It's only about $20,000 more but it would be too much for me to shell out and have to wait 4 months to start to recover.
If you have an idea what your first order quantity will be, please furnish it now. The book will sell for $24.95, so you could sell 500 for $12,475 and it will only cost you $6861.25 for this many copies. I would recommend you buy as many as you can for your initial order as the 45% discount only applies once.
This email may not be forwarded to other people who you know that are book distributors. You may pass the information on by contacting them yourselves. You may include their orders in with your own at the first time buy rate.
Mr. Fischer is not interested in "opening up the doors" to many different booksellers. Specifically, he has forbidden me to deal with Amazon at all. So, those of you who are reading this are at the top of the pyramid. You can resell to other resellers and work with them to profit for yourself.

Mr. Fischer will offer an addtional 5% off on the first person to order 1000 or more books, one time only, up to and including the whole 50,000 copies.
I can't check the bank today because of the holiday but I fully expect the $$ back in my account.
At this point, the order total is at 7,000 not counting yours. If you put in for 2,000 you will outperform the single highest order of 1,500 so you would get the 50% discount for all 2,000.
On September 15 I will send out letters to the candidate dealers showing what the highest order tally is. I will not disclose who the highest bidder is, of course. I will give everyone 2 weeks to consider revising their quantity in the event anyone is close to the mark of being #1 and qualifying for the discount.
As of October 1, I will have a definite ship date for the book to resellers. I will then specify that the order quantities will be held based on deposits on the total of the order.
25% down on the order would be required to seal your order quantity. Otherwise, someone could just say they want 10,000 and then not order anything, meanwhile someone else would be billed in excess since they would have qualified for the discount.
I will allow everyone to place their 25% order down as if they were the top bidder, and I will adjust the amount due prior to shipping.
By the way, Fischer insists on doing the first batch of orders to everybody from Iceland. I think he feels that he might be getting ripped off. So, all of the books you get will physically be mailed out by Bobby, or, more than likely, one of his helpers.
Once he sees how much work is involved, I expect he will turn things over to my team.
As can be expected, occasionally Mr. Fischer is adjusting the procedures regarding the book. The good news is that there is nothing untoward with this latest volley of requests. There is some bad news...for some of you.
The bad news is, 7 of you are not allowed to be distributors of the book. Mr. Fischer's reasons are not that of a mentally stable individual. If you received an email entitled "Fischer says No Way" with his mean text in the body, then you are one of the 7.
I must personally apologize for the vitriolic attack that Frank Brady suffered under Bobby's tirade. I don't know why Mr. Fischer copied me and so many others on that email he sent out. Sir, my apologies.

I completed up to and including page 145. I am starting to understand his writing better and most of the diagrams are exactly as in his previous book. I hired a consultant to just create all of the diagrams in "My 60" and email them to me. This has been a great time saver.
The new procedures for the book ordering process:
If you are the person who placed the order for 5,000 books, you have qualified for the one-time 50% discount rate. Everyone else will get their first order quantity at 45% and 35% on all re-orders forever after this.
The 50% tier pays $12.48 per book.
The 45% tier is $13.72 per book.
The 35% tier is $16.22 per book.
The selling price is $24.95 per book.
To set things in motion:
1. Put 25% down on your total order no later than October 1. This is more to finalize your quantities and confirm your purchase. This check should be made out to Edward Trice at the address I will furnish later. If your check arrives after October 1, I have been instructed not to accept your order.

Everyone else, send $3430 per 1000 copies.
2. I will enclose a PDF file that you MUST print, sign, and return to Fischer in Iceland. PLEASE KEEP THIS ADDRESS CONFIDENTIAL! I will sent this out this coming week.
3. Your 75% final payment must be in Canadian dollars, using the October 1 exchange rate, and this must be a bank check made payable to cash and sent to Fischer in Iceland. PLEASE DOUBLE CHECK WITH ME before sending this out! Fischer says if anyone is off by more than a nickle, high or low, he won't send the books!
This payment is due November 1 at his Iceland address.

5. On December 1, the books will ship to the person with the highest order count. On December 10, all of the other books will be sent out.

I must say that I agree with your assessment of Ed Trice. One thing that I noticed that you have not yet alluded to. This caught my attention because of an investigation on another matter that I was questioned about some years ago when a friend was getting a security clearance.
The "proceedure" of sending the 25% book order deposits to Canada in Canadian funds. Were US funds sent to Ed Trice in the US, he would be open to fraud charges and civil liability. It would be virtually impossible however, to prosecute him for a fraud crime commited from Canada and presumable Iceland. It would also be nearly impossible to prosecute him from Canada as he is in the US..........and that assumes that the Canadian authorities even would care since, no Canadian citizens would have been victims. There would not even be a money laundering case possible, since all the funds would be Canadian upon arrival.
In short.....this was an internet version of the old Jesse James........do your robbery, then high tail it across the border out of jurisdiction.

Well, Fischer's new terms have made it impossible for me to commit any $$$ at this time. I wish I could talk to you about how absurd his program of purchasing is. I've been in the book business since 1976...his terms are beyond WACKO and UNACCEPTABLE. I for one can't afford to have $$ out for three months, hoping I didn't piss him off somehow and won't get my books...and just hoping to recoup. And with him being in Iceland, how does one enforce any contracts with him. He is essentially JUDGMENT PROOF!!
And am I correct in understanding that all 100,000 books are being shipped from Iceland??? That's insane.
Oh well, I really, really wish you the best of luck, but Fischer's has really made the terms extraordinarily unreasonable. I'll sit on the sidelines for now, and should the books be available for purchase after the first of the year with much more reasonable terms, I know I'll be interested then.

I told you he was going to be difficult about all of this and that just because he says something one day doesn't mean he is going to stick to it in the end. I got him to change his mind about the pricing based on your input, and I got him to reconsider more than one of his stances based on things you and I had discussed over the phone.
Now the person primarily responsible for these changes bows out of the process. What am I supposed to say to him? "The guy who talked you into lowering your reseller rates doesn't want any of your books?"
Bobby is looking for commitments to buy the book so that he has money to survive. Now, we both know this is his own doing, but in the last few communications with him he has really come around. He invited me to a function at a private retreat house in Copenhagen, which is a place he was given free access to whenever he wants (although I am told it is not his) and I asked him if I could make a video diary of the trip, and he said "Well....I guess."
I think Fischer is finally coming to terms with his own mortality and his return to publishing, though for different reasons, is clearly a sign he is trying to steer his own way through the fog in his mind. Fischer is his own worst enemy, and the fact that he has NOBODY to talk to anymore, and he must resort to transatlantic dialog with me, is again a further indication that his own solitude is no longer as appealing to him as it once was.
Your 25% down on 500 books would be $1750, or $6860 for the 2,000 books, whichever. How are these terms "grossly unreasonable?" If they are so unreasonable, why then do I have emails back for go-aheads on 7,500 books so far?
Fischer's offer stands. No doors will be opened after October 1. Those who buy from him now will have access to the only distribution channel for this book. I have all of the material. I paid 50% down to get the print run started. Even if Fischer pulls the plug tomorrow, I have the right to sell all 50,000 copies of the book since I paid for it and I have a signed Power of Attorney form from his lawyer authorizing me to proceed.
I estimated to Bobby I would be able to pay him 25% on roughly 10,000 books on October 5, now I have a gap of about 2,500 (I am expecting a confirmation of another 500 this week.) He will find this discouraging.

The print run WILL BE COMPLETED by mid November, so you are only "out" the money for 2 weeks from his point of view. Now Ed, do the math. I'm printing 50,000 and only sending about 7,000 to Iceland, so how many are going to be in my basement???
I have to send them to Bobby in Iceland so that he can "audit me". This is the only way he will accept doing business, since otherwise I would be able to sell things and he would have no idea what is going out the door. He can also "call me to the carpet" at any time, and I must send the rest to him.
Example: Say I sent out 7,000 books to him in Iceland. He has them shipped from there. Then he tells me "Send me the next 43,000."
Suppose I sold 10,000 and didn't tell him? Then he will know I cheated him, and I will be dead meat basically.
So, the deal is, any bulk orders come in, I send them to him, he "keeps his tally", but he can ask for the others at any time (he pays the shipping).
It does not behoove him to have tens of thousands of books sitting around either, as I am his link to selling environment. He can't sell them unless I give him destinations to ship and money for the orders.
So, while it is "unorthodox", it's the way you have to do things for Fischer.
Careful analysis will reveal Bobby did leave one loophole in place, which can be exploited.
Say you don't want to deal with the double-shipment time delay back and forth to Iceland. There's a perfect work around, but you better not show this email to anyone!
Say you want 500 books but you don't feel like sending Canadian money to Bobby based on the October 1 exhange rate of USD versus Canadian $$. I can ship them directly to you, cutting out all of the nonsense. You can then sell them at your leisure, and you will have them at once. Even if Bobby orders an audit whenever, I can say you ordered 500 books that day, so all will balance out. He will ship the books to you, but you will have already sold them, so you can hold onto them until your next order, or, if Fischer audits me, I can pay for you to ship them back to me so I can reship to Bobby so that the audit is passed.
Worse case scenario, I can order some extra from the printer so that I am "always" in compliance with an audit, and just have high volume resellers agree to reship to me anything sent to them by Fischer.
Fischer just hates the concept of people making money off of "his name", but he does not understand that you can't sell B2C and do the same volume as B2B. So, he'd rather convolute the whole process than try to sleep at night wondering if someone sold a copy of a book somewhere that he didn't authorize.

If you read the story in the book that I had posted on the website, Benko was staying with Betty Roberts and Fischer joined them. She added the date herself as a remembrance of the 'historic' occasion. The handwriting is different, and the writing instruments are different, thereby suggesting different authors, different times.
Bobby Fischer's "My 61 Memorable Games" is at the printer's right now for the final cut. Since his hospitalization for 5 weeks with kidney problems, Fischer has adjusted his requirements yet again. He had previously established resellers in Canada, Greece, Hungary, the Philippines, and Australia. He has not lifted his boycott against American and "Russian" resellers. He has also changed his procurement procedures and quantities.
The book "lists" for $24.95.
As few as 100 copies can be bought for $1500. Other quantities:

1,000 copies are $11,500
All orders with U.S. destinations can be placed through me. Contact me if interested. Only 50,000 copies will be printed on the first run.
I just got off the phone with an Amazon rep. who called me asking about ordering 5,000 copies of the Fischer book. I told him that my arrangement with Bobby Fischer does not allow me to resell to Amazon, but one of my book distributors might be able to buy then resell back to Amazon. He then quoted me their policy of deep discount purchasing, blah blah blah, so then I said "OK, well forget it then" and he immediately shouted "Wait!".
I told him he is wasting my time, and he changed his tune dramatically. We talked on for another 10 minutes.
So apparently he needs to get an approval from someone higher up in the chain of command in order to override their offer to buy this book at a rate each of you can then, in turn, resell to them. Even if you make $2 or $3 per copy this is a quick $15,000 in profit to whoever wants to sell to this guy.
This is a time sensitive offer, the first to reply will get his contact information. You will most likely be the contact point for all subsequent Amazon book re-orders, this could be a business unto itself.

I was paid to lay out the book and get Bobby a publisher. I've had no further involvement with the book deal. In fact, after having heard that the blue line was acceptable and the printing started, I called the printing facility to make sure everything was alright.
The person on the phone said: "While we are appreciative of your hard work, Mr. Fischer insists that your role is completed now and we can have no further contact. Thank you." And with that, they hung up. I found out later Fischer was thinking I was going to talk somebody into sending me some copies of the book.
So, Bobby talked somebody into shelling out cash to get these books printed and left them high and dry, again. Apparently even he no longer has the rights to this book, and has not resolved the issue with Batsford (or whomever), as he has previously claimed. Still, there's thousands of these books somewhere in the frost of Canada somewhere.

Bobby is a nut job, as you know. That's why I got my money for this project up front. It will be interesting to see what happens next. Individual copies of the book will crop up online after February I bet. I don't think eBay can halt all of these potential mini-auctions, but you never know.

The printing began in early December, as scheduled. The day after my check cleared (payment for the work I did) that's when they let me know "I was done."
It now seems that even Bobby Fischer does not own the rights to his "My 60 Memorable Games" book. Originally published by Simon & Schuster in 1969, then redone (very poorly) by Batsford in 1995. There is a searing account of Fischer's hatred of this edition at this link:
...where he claims the books were "forged and unauthorized." You can read there to see what eventually led to Batsford's "getting out of the market", paving the way for Faber & Faber to retain the sole rights to the book.
Fischer has many "minions" to do his bidding. There is rarely direct contact with him, of any form. One of these trusted colleagues must have crafted this deal, or else Fischer surrounded himself with ample enough supply of "plausible deniability" that when Faber learned of this, nothing came back to him. Even the Canadian eBay account holder was mentioned on several sites as having been "duped" into having to pay for the shipping charges to her location. In short: There is no money trail linking Fischer to any of this, and everyone who paid money, has books they cannot sell using traditional means.
So what did Fischer get out of this? There are thousands of books rotting in a cellar in Canada which will be "given away" according to the eBay woman who is distraught at having been "used." She intends to take them all to a mall parking like and affix a sign "FREE CHESS BOOKS, TAKE AS MANY AS YOU WANT."
I tried to talk her out of this action, to no avail. She did promise to give me 24 hours notice and the location of the mall. Since they are in the throngs of very bad weather, this won't be for a while yet.
Still, what Fischer has created was another media spotlight for himself. No doubt, in upcoming days, he will fault "the Jews" for all of this, or issue forth similar noise. Everyone involved were less than pawns in another Fischer debacle.

Nevertheless, libel and slander is a civil matter, not criminal, and any 'First-Hour' law student knows that Police and Sheriff's jurisdiction therefore don't extend to the internet unless there's a criminal act being perpetrated.
